Terms of Use

These terms are an agreement between you and blue6 LLC ("we", "us") for using Action, our app for making and sharing videos with an AI editor. By using Action you agree to them, and to our Privacy Policy.

Who can use Action

You must be at least 13 (or older, if the law where you live requires it). You're responsible for your account and for what happens through it.

Credits

• Edits are paid for with credits, which you buy in the app through Apple or receive from us as a promotion.
• Credits have no cash value, can't be transferred or exchanged, and are non-refundable except where the law requires otherwise. Purchases are handled by Apple, and refund requests for purchases go to Apple.
• We may change credit prices and packs in the future; that won't change the credits you already have.

Quotes and charges

• Before an edit is made, you see a quote: each paid step at the price of the model that makes it, plus the most the AI editor's time can cost. Nothing is made, and nothing is charged, until you approve.
• When you approve, we hold the quoted credits. You're charged for the steps that finish and for the editor's actual time, never more than the quote, and the rest comes back to you.
• If an edit fails and no video is delivered, its credits are refunded.
• A quote you don't approve expires after a day.

AI edits

AI-made video can be imperfect and results vary, so we can't promise a particular result. The editor checks its work against what you approved, and tells you plainly when part of the request couldn't be met. An edit delivered with such a note is still charged as described above.

Your content

• Your clips, requests and the videos made from them belong to you, as far as the law allows.
• You give us a license to store, process and transmit your content, including through the providers named in our Privacy Policy, only to run Action for you: to make your edits, show them to you, and share them the way you choose.
• You must have the rights to everything you record, import or use as a reference, including permission from the people in it.

What you can't do

Don't use Action to record, request, upload or share:

• anything illegal, or that infringes someone else's rights;
• sexual content involving minors, or sexual or intimate imagery of anyone without their consent;
• content that harasses, threatens or demeans people;
• videos that make a real person appear to do or say something they didn't, in a way meant to deceive or harm;
• attempts to break, overload or misuse the service, or to get around its limits or credits.

You can report content and block people in the app. We may remove content and suspend or close accounts that break these terms.

Changes and ending

Action is new, and we'll keep changing it: features may change or end. If we change these terms in a way that matters, we'll tell you in the app. You can stop using Action and delete your account at any time; we may suspend or end your access if you break these terms.

Disclaimers and liability

Action is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. To the extent the law allows, blue6 LLC isn't liable for indirect, incidental or consequential damages, and our total liability for any claim about Action is limited to the greater of what you paid us in the 12 months before the claim and $50.

Apple

These terms are between you and blue6 LLC, not Apple. Apple isn't responsible for Action or its content, and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of Action must also follow the App Store's terms.

Law

These terms are governed by the laws of the state in which blue6 LLC is organized, and the laws of the United States, without regard to conflict-of-law rules.
